Terms of Service

1. Purpose

These Terms of Service (the "Terms") govern access to and use of the Vintew platform (the "Service"), available at vintew.com. By using the Service, you agree to these Terms.

2. Registration

Registration is open to adults and legal entities. Registration is completed by verifying your email address with a one-time passcode (OTP). You are responsible for keeping your account secure and for activity carried out through it.

3. Posting listings

• Listings must accurately describe the item or service offered. Listings must be written in French.
• You may not post unlawful, misleading or discriminatory content, or content that infringes another party's rights.
• Vintew may remove or moderate listings that do not comply with these Terms.
• Each listing may be assessed for quality. Low-quality listings may be ranked lower or rejected.

4. User responsibilities

Transactions take place directly between users. Vintew provides a platform for users to connect and is not responsible for disputes between users, the quality of items or services offered, or a transaction that is not completed.

5. Messaging

The Service provides in-app messaging. Users must not use it for spam, harassment or distributing unlawful content. Messages may be automatically analyzed for moderation and fraud detection.

6. Trust and verification

The Service assigns users a trust level based on completed verifications (phone and email). This level is indicative and is not a guarantee of a user's reliability.

7. Paid services - Terms of Sale

These Terms of Sale apply to purchases of paid services on the platform (listing boosts and Pro subscriptions) and supplement the Terms above.

7.1 Service description

• Listing Boost: increased visibility for a listing for a selected period (24 hours, 72 hours or 7 days).
• Pro subscription: a package of advanced features for professionals (analytics, multiple listings, Pro badge and priority support), available monthly or annually.

7.2 Pricing and invoicing

• Prices are shown in euros. Prices displayed to consumers include all taxes. Prices for professionals are shown excluding tax, and applicable VAT (20%) is added at checkout.
• The Service may change its prices at any time. Changes do not apply to orders already confirmed or to active subscriptions until their renewal date.
• An invoice compliant with Articles 289 and 242 nonies A of the French General Tax Code is issued for each transaction and made available in your account.

7.3 Payment

• Payment is made by credit or debit card (Visa, Mastercard) or SEPA transfer through our secure payment provider.
• Payment is due when the order is placed. Access to the service is enabled once payment is confirmed.
• Business customers (B2B): under Article L441-10 of the French Commercial Code, payment is due within 30 days of the invoice date. Late payment automatically incurs:
  • Late-payment interest at the ECB rate plus 10 percentage points
  • A fixed EUR 40 recovery fee (Article D441-5 of the French Commercial Code)

7.4 Subscription term and renewal

• Pro subscriptions are purchased for the selected term (monthly or annual) and automatically renew for the same term unless cancelled.
• Under Articles L215-1 to L215-3 of the French Consumer Code, you will be notified by email no later than 30 days before the renewal date that you may choose not to renew your subscription.
• Cancellation takes effect at the end of the current period. No refund is due for the remaining period except as provided in Section 7.5.
• You may cancel at any time from your account or by emailing [email protected].

7.5 Right of withdrawal

• Consumers: under Article L221-18 of the French Consumer Code, you have 14 days from the date of purchase to exercise your right of withdrawal, without giving a reason or incurring a penalty.
• However, under Article L221-28(1) of the French Consumer Code, the right of withdrawal cannot be exercised if the service has been fully performed before the withdrawal period ends and you expressly waived that right when placing the order.
• For Listing Boosts, a full refund is granted if the service has not yet started. Once a Boost is in progress, the right of withdrawal has expired.
• To exercise your right of withdrawal, email [email protected] with your account ID and the word "withdrawal". The refund will be issued within 14 days using the original payment method.
• Business customers (B2B): the right of withdrawal does not apply to purchases made for business purposes (Article L221-3 of the French Consumer Code).

7.6 Guarantees and liability

• The Service undertakes to provide paid services as described. If a technical failure prevents delivery of the service, a refund or extension will be provided.
• The Service does not guarantee a minimum number of views, contacts or sales resulting from the use of paid services.
• The Service's liability is limited to the amount paid by the user for the service concerned.

7.7 Dispute mediation

Under Articles L611-1 and R612-1 of the French Consumer Code, if a dispute is not resolved by our customer service team within 30 days, you may use the following mediation service free of charge:

7.8 Withdrawal form

8. Intellectual property

Content posted by users remains their property. By posting on the Service, you grant a royalty-free, non-exclusive license to display and promote your listings on the platform.

9. Suspension and termination

The Service may suspend or delete an account if these Terms are violated, in the event of fraudulent activity, or at the request of competent authorities. You may delete your account at any time from your settings.

10. Changes to these Terms

The Service may change these Terms at any time. Users will be notified of any material changes. Continuing to use the Service after a change constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by French law. Any dispute shall be subject to the exclusive jurisdiction of the French courts.
